Terms of Use

NAMI is a subscription video-on-demand service operated by Amateta Technology & Graphics CC, a close corporation registered in the Republic of Namibia with its principal place of business in Windhoek ("Amateta", "we", "us").

These Terms of Use form the agreement between you and Amateta for your use of the NAMI website, applications, smart-TV apps and any other way we make the service available. By creating an account or using NAMI you accept these terms. If you do not accept them, please do not use the service.

A NAMI membership gives you a personal, non-exclusive, non-transferable and revocable licence to stream the catalogue for private, non-commercial viewing while your membership is active and in good standing.

You must be at least 18 years old, or have the consent of a parent or guardian who accepts these terms on your behalf, to hold an account. The account holder is responsible for everything that happens on the account, including viewing by members of the household.

Membership continues until cancelled. The plan you choose determines the video quality available to you and the number of devices that may stream at the same time. Those limits are enforced by the service.

The subscription fee for your plan is charged in advance for each billing period, in the currency shown at checkout. Prices are displayed inclusive of any taxes that apply in your market.

Your membership renews automatically at the end of each billing period unless you cancel before the renewal date. We will tell you before a renewal price changes, and you may cancel rather than accept the new price.

Where a payment method is used that requires you to initiate each payment — such as a bank transfer — your membership stays active until the end of the period you have paid for, and we will remind you before it lapses.

If a payment fails, we allow a short grace period during which your access continues while you fix the payment method. After that period, streaming is suspended until payment succeeds. Your profiles, lists and viewing history are kept.

We may offer a free trial on some plans. A trial is available once per account and once per payment method, and eligibility is at our discretion. We may refuse or withdraw a trial where we reasonably believe it is being abused.

Unless you cancel before the trial ends, the membership converts to a paid membership at the price shown when you signed up.

You can cancel at any time from Account → Membership. Cancellation takes effect at the end of the period you have already paid for; you keep access until then, and you are not charged again.

Because NAMI is a digital service delivered immediately and consumed continuously, subscription fees for a period already started are generally not refundable. This does not affect any right you have under Namibian law or the law of your market that cannot be excluded by agreement.

If NAMI is materially unavailable for a prolonged period through our fault, contact support and we will put it right, normally by extending your membership.

Your plan allows you to create profiles for the people in your household, each with its own recommendations, list and viewing history.

A profile can be marked as a kids profile, which restricts the catalogue to age-appropriate titles and presents a simplified interface. Maturity ratings are applied per profile and can be protected with a PIN.

Ratings are a guide, not a guarantee. A parent or guardian remains responsible for supervising what children watch, and for keeping profile PINs private.

NAMI is licensed to you for personal viewing. You agree that you will not:

• Copy, record, download, re-transmit, publicly perform or redistribute any part of the catalogue, except through features we provide for that purpose.
• Circumvent, remove or interfere with any content protection, geographic restriction, watermark or access control applied to the service.
• Share your account credentials outside your household, or sell, rent or otherwise make your access available to others.
• Use bots, scrapers, or any automated means to access the service, or attempt to probe, scan or test the security of our systems.
• Reverse engineer, decompile or attempt to derive the source code of any part of NAMI, except to the extent that applicable law expressly permits it.
• Use NAMI in any way that is unlawful, or that infringes the rights of Amateta, our licensors or anyone else.

We may suspend or terminate an account that breaches these rules, and we may report unlawful activity to the relevant authorities.

Titles are licensed to us for particular territories and periods. The catalogue therefore changes over time and differs between markets, and a title you have started may leave the service before you finish it. We do not guarantee that any particular title will remain available.

Streaming quality depends on your plan, your device and your internet connection. NAMI adapts the video quality to the bandwidth available so that playback continues.

All titles, artwork, trademarks and software on NAMI belong to Amateta or to our licensors and are protected by copyright and other laws. Nothing in these terms transfers ownership of any of it to you.

If you submit a film, a series or any other material to us — for example through our partner submissions process — you confirm that you hold the rights you claim to hold, and you grant us permission to evaluate it. Evaluation creates no obligation to license, publish or pay for the work; any licence is agreed separately and in writing.

Do not send us confidential information you are not willing for us to receive on that basis.

We work to keep NAMI available, but we do not promise uninterrupted service. Maintenance, network failures, third-party outages and events beyond our reasonable control can all interrupt streaming.

We may add, change or remove features, and we may change these terms. Where a change materially affects your rights, we will give you reasonable notice by email or in the app. Continuing to use NAMI after a change takes effect means you accept the revised terms.

NAMI is provided on an "as is" and "as available" basis. To the fullest extent the law allows, we exclude implied warranties and we are not liable for indirect or consequential loss, loss of profits, or loss of data arising from your use of the service.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Where our liability cannot be excluded, it is limited to the amount you paid us for the twelve months before the event giving rise to the claim.

You may close your account at any time from Account → Security. Closing an account ends your access, cancels any active subscription and begins deletion of your personal data as described in the Privacy Policy.

We may suspend or end your membership if you breach these terms, if payment cannot be collected, or if we are required to do so by law. Where the circumstances allow it, we will tell you first and give you an opportunity to put things right.

These terms are governed by the laws of the Republic of Namibia, and the courts of Namibia have jurisdiction over any dispute, without limiting any right you have to bring proceedings in the country where you live.

Please contact us first — most problems are settled quickly by our support team, and we would rather fix something than argue about it.
